The course aims in learning the basic principles of Labour law and the trade union law, as well as the knowledge of the main rules governing the establishment, conduct and the resolution of labor relations (private), starting from the distinction between subordinate employment and self-employment, even in light of recent legislative reforms, to analyze the conditions for the lawfulness of dismissal , individually and collectively, and any resulting penalties for illegitimacy.

The course aims at the analysis of the main sources which regulate labour relations, with a focus on the relationship between the Italian Constitution, laws (legal sources) and the collective agreements (Trade Union source-contract), even through the exhibition of the main characteristics of the Italian Trade Union system.
Particular attention is then devoted to the study of the definitions of employee and self-employed ratio, then addressing in detail the main steps that characterize the performance of an employment relationship, the method of recruitment to the probationary period, the issue of duties and of any changes thereto by the employer, to the study of the period of acting due to illness , accident or pregnancy. We’ll analyse the rules and procedures that legitimise the adoption by the employer of disciplinary sanctions.
In addition we will focus on the distinction between dismissal and resignation and the institution of notice and compensation. Will the discipline of dismissal, hinting also the distinction between collective and individual dismissals, with particular reference to the latest legislative reforms and recent interpretations of the law. Will be exposed to the concepts of just cause and justified grounds for dismissal and will be analyzed the most recent legislative reforms relating to layoffs.
The last part of the course will be devoted to the analysis the transactions, contextual or following the termination of an employment relationship, taking into account also the tax issues related to such waivers and trades.
Finally we will analyze some particular working contracts as temporary contracts, part-time contract.
During the course the students will receive some materials (texts of laws, of COLLECTIVE LABOUR CONTRACTS, documents etc.) on whom to take lessons in order to proceed with the analysis of case studies through the application of theoretical institutes covered in class.
